1. Overview

This website, prismsky.store, is operated by PrismSky ("PrismSky", "we", "us", "our"). By visiting our website, creating an account, or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), together with our Refund Policy, Shipping Policy, and Privacy Policy, which form part of these Terms. If you do not agree to these Terms, please do not use our website or purchase our products.

We may update these Terms from time to time. The version in force at the time you place an order applies to that order. Continued use of the website after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least the age of majority in your place of residence to place an order. By placing an order, you confirm that you meet this requirement and that the information you provide is true, accurate, and complete.

We currently sell and ship only to customers in the United States, Canada, Australia, and New Zealand.

3. Our Products

All products are printed on demand by our third-party fulfilment partner after your order is placed.

Product images, including mockups and lifestyle photographs, are for illustration only. Actual colours, textures, and appearance may vary due to screen settings, printing processes, and materials. Such variations are not defects.

We make reasonable efforts to describe our products accurately, but we do not warrant that product descriptions, images, or other content on the website are error-free, complete, or current.

4. Orders and Acceptance

Your order is an offer to purchase. The order confirmation email you receive confirms that we have received your order; it does not mean your order has been accepted. A contract between you and us is formed only when we dispatch your order to production or shipment.

We reserve the right to refuse or cancel any order, in whole or in part, at any time before dispatch, including where:
- the product is unavailable;
- there is an error in the price or product information;
- we suspect fraudulent, unauthorised, or unlawful activity; or
- the order would require shipping to a country we do not serve.

If we cancel an order after payment has been taken, we will refund the full amount paid to your original payment method.

5. Prices and Payment

All prices are shown in the currency displayed at checkout and include the price of the product only. Shipping charges are shown separately at checkout. Prices do not include import duties, customs fees, or local taxes charged by your country on delivery, which are your responsibility unless stated otherwise at checkout.

We may change prices at any time without notice. Price changes do not affect orders already accepted.

If a product is listed at an incorrect price due to an error, we may cancel the order and refund you in full, even after you have received an order confirmation.

Payments are processed by third-party payment providers. By submitting payment, you confirm that you are authorised to use the payment method provided.

6. Shipping and Delivery

Shipping is governed by our Shipping Policy. Delivery times are estimates and are not guaranteed. You are responsible for providing a complete and accurate shipping address.

7. Returns, Refunds, and Cancellations

Returns, refunds, and order cancellations are governed by our Refund Policy.

8. Intellectual Property

All content on this website, including all artwork, designs, images, text, graphics, logos, and the PrismSky name, is owned by or licensed to PrismSky and is protected by copyright, trademark, and other intellectual property laws.

Purchasing a product gives you ownership of that physical item only. It does not transfer any copyright or other intellectual property rights in the artwork or design, and does not grant you any right to reproduce, copy, scan, photograph for resale, distribute, modify, or commercially exploit any of our designs.

You may not copy, reproduce, download, scrape, or use any content from this website, including for the purpose of training artificial intelligence or machine learning models, without our prior written permission.

9. Reviews and Communications

If you submit a review, comment, photograph, or other content to us or on our website, you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display, and publish that content in connection with our business, including in marketing. You confirm that you own or have the right to share any content you submit and that it does not infringe the rights of any third party or contain unlawful material.

10. Prohibited Uses

You agree not to use the website:
- for any unlawful purpose or in breach of these Terms;
- to submit false, fraudulent, or unauthorised orders or payment information;
- to infringe our intellectual property or the rights of others;

Our website is hosted by Shopify, products are produced and shipped by third-party fulfilment partners, and payments are processed by third-party payment providers. Your use of those services may be subject to their own terms. We are not responsible for third-party websites linked from our website.

12. Your Consumer Rights

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by law, that cannot lawfully be excluded or limited. This includes the consumer guarantees under the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993, and consumer protection laws applicable in the United States and Canada. These Terms apply only to the maximum extent permitted by law.

13. Disclaimer

Subject to section 12, the website and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no warranties or representations, express or implied, regarding the website, including that it will be uninterrupted, secure, or error-free.

14. Limitation of Liability

Subject to section 12 and to the maximum extent permitted by law:
- our total liability to you for any claim arising out of or relating to an order or these Terms is limited to the total amount you paid for the product(s) that are the subject of the claim; and
- we are not liable for any indirect, incidental, special, or consequential loss, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the website or any product.

Where our liability for failure to comply with a consumer guarantee cannot be excluded but may be limited, our liability is limited, at our option, to replacing the product, supplying an equivalent product, or refunding the price paid for the product.

15. Indemnity

To the extent permitted by law, you agree to indemnify PrismSky against any claim, loss, or cost (including reasonable legal costs) arising directly from your breach of these Terms or your infringement of any law or the rights of a third party, except to the extent caused by our own act or omission.

16. Events Beyond Our Control

We are not responsible for any delay or failure to perform our obligations caused by events beyond our reasonable control, including carrier delays, fulfilment partner disruptions, natural disasters, pandemics, strikes, government actions, or internet or power failures. If such an event significantly delays your order, we will notify you and you may cancel the affected order for a full refund.

17. Disputes

If you have any concern about an order or these Terms, please contact us first at support@prismsky.store. We will try in good faith to resolve the matter informally within 30 days.

18. Governing Law

These Terms are governed by the laws of India. Subject to section 12, the courts of India have jurisdiction over any dispute arising from these Terms. This does not deprive you of the protection of any mandatory consumer protection laws of your country of residence, or of any right to bring proceedings in your local courts where such right cannot be excluded by law.

19. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. We may assign or transfer our rights and obligations under these Terms. These Terms, together with the policies referred to in them, constitute the entire agreement between you and us regarding your use of the website and your purchases.
